Terms of Service

These Terms of Service (“Terms”) govern your use of the oaks.delivery website and the Oaks & Corks mobile application (together, the “Service”), operated by Sironka Limited T/A Oaks and Corks (“Oaks & Corks”, “we”, “us”, “our”), a company registered in Kenya. By browsing the Service, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.

Please also read our Privacy Policy, which forms part of these Terms.

1. Age & eligibility — 18+ only

We sell alcoholic drinks. Under the Alcoholic Drinks Control Act, 2010, it is illegal to sell alcohol to, or to buy alcohol on behalf of, anyone under 18. By using the Service you confirm that you are at least 18 years old and that any order you place is for your own consumption or for another adult.

You must not order alcohol for anyone under 18. Our rider may ask for a valid photo ID on delivery, and may refuse to hand over an order if they cannot confirm the recipient is 18 or over, if the recipient appears intoxicated, or if handing over the order would be unlawful. Where an order is refused for these reasons, the cost of the alcohol may be refunded but the delivery fee may be retained.

2. Your account

You sign in with your mobile number and a one-time PIN (OTP) sent by SMS. You are responsible for the phone number and device you use to access your account and for keeping access to your account secure. Please give us accurate, current contact and delivery details — we rely on them to reach you and to deliver your order. Tell us promptly if your number changes or you suspect unauthorised use of your account.

3. Products, prices & availability

All prices are shown in Kenya Shillings (KES) and are inclusive of VAT where it applies. A delivery fee may be added at checkout and is shown to you before you confirm your order. Product images are for illustration; packaging, vintages and labels may vary.

We try to keep pricing and stock accurate, but availability depends on live stock and prices can change. If an item you ordered is unavailable, or we discover a genuine and obvious pricing or description error, we may contact you to offer an alternative, or cancel and refund the affected item.

4. Placing an order

When you place an order you are making an offer to buy. Your order is accepted, and a contract formed, only when we confirm the order and assign it for delivery. We may decline or cancel an order — for example where an item is out of stock, where we cannot verify age or the delivery address, where delivery is outside our service area, where payment is not received, or where we reasonably suspect fraud or misuse. If we cancel an order you have already paid for, we will refund it.

5. Payment

You can pay by M-Pesa, by card, or — where offered — by cash on delivery. By submitting payment details you confirm you are authorised to use the payment method. Card and M-Pesa payments are processed by our payment partners; we do not store full card numbers. Where you pay cash on delivery, please have the correct amount ready, as riders may not carry change. We may place a hold on, or decline, an order where payment cannot be confirmed.

6. Delivery

We deliver within our Nairobi service area. Delivery times shown (for example “in about 30 minutes”) are estimates, not guarantees, and can be affected by traffic, weather, demand and your location. Someone aged 18 or over must be present at the delivery address to receive the order and may be asked for ID. Please make sure the delivery address and any instructions are accurate and that your phone is reachable. If we cannot complete delivery because no suitable adult is available, the address is wrong or unreachable, or access is refused, we may return the order; a re-delivery or a refund (less costs already incurred, such as the delivery fee) will be handled case by case.

7. Cancellations, returns & refunds

Because we deliver quickly, you can cancel or change an order at any time before it is handed over — including by handing the items back to the rider at the door, for any reason. In that case we refund the price of the returned goods in full.

Once an order has been delivered and accepted, we cannot accept returns or exchanges, except where an item arrives damaged, leaking, expired, or is not what you ordered. Please check your order at the point of delivery and report any breakage, shortage or wrong item to the rider on the spot or to us as soon as possible, with a photo where you can, so we can put it right. This does not affect any rights you have under Kenyan consumer law.

Approved refunds are issued either as credit to your Oaks & Corks wallet or back to your original payment method, at our discretion and as appropriate to how you paid.

8. Loyalty points & wallet credit

We may offer loyalty points and wallet credit. Points and credit have no cash value, cannot be exchanged for cash, and may be redeemed only against orders on the Service. We may set, vary or withdraw how points and credit are earned, redeemed or expire, and we may adjust or remove points or credit that were awarded in error, through a cancelled or returned order, or through misuse.

9. Acceptable use

You agree to use the Service only for lawful purposes and not to: provide false information or impersonate another person; order alcohol for anyone under 18; resell products bought through the Service without our consent; or interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems.

10. Intellectual property

The Service and its content — including the Oaks & Corks name and logo, text, graphics, and software — are owned by or licensed to us and are protected by law. You may use the Service for your own personal, non-commercial use only, and may not copy, reproduce or exploit any part of it without our prior written permission.

11. Disclaimers & limitation of liability

The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will always be uninterrupted or error-free. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, and our total liability to you in connection with any order is limited to the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold harmless Oaks & Corks and its officers, employees and agents from any claim arising out of your breach of these Terms or your misuse of the Service, including any order placed on behalf of, or for supply to, a person under 18.

13. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page. Changes take effect when posted, and your continued use of the Service means you accept them. Please review this page periodically.

14. Governing law

These Terms are governed by the laws of Kenya, and any dispute relating to them or to the Service is subject to the jurisdiction of the courts of Kenya.
